Devine OS and any associated vaults or strategies rely on smart contracts, MPC systems, APIs, bridges and other software and infrastructure that may contain bugs, vulnerabilities, design flaws or implementation errors. By interacting with Devine OS, you expressly acknowledge and accept that smart contracts, vaults, MPC wallets, exchanges, protocols, bridges and other components may fail, be misconfigured, be exploited or behave unexpectedly. The platform, its dependencies or connected third-party services may suffer cyberattacks, hacks, key compromises, denial-of-service incidents, data corruption, chain reorganisations, forks or other operational failures. Stablecoins, collateral assets, protocols and venues may de-peg, halt withdrawals, suffer insolvency, be sanctioned or cease operations without notice. Network congestion, gas price spikes, RPC failures and infrastructure outages may delay, reorder, revert or prevent your transactions. DG does not and cannot guarantee continuous, secure, error-free or exploit-free operation of Devine OS or any related contracts, wallets or integrations.

NO WARRANTY

To the maximum extent permitted by applicable law, Devine OS, this website, and all related software, interfaces, APIs, vaults, dashboards, analytics and documentation are provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, availability, reliability, accuracy or completeness.

DG and its affiliates do not warrant that Devine OS or any vault, protocol or service will be secure, uninterrupted, timely, error-free or free of vulnerabilities; that any defect, bug or vulnerability will be discovered or corrected; or that any data, metric, price, NAV, P&L, position, risk or performance information shown is complete, up to date or correct. You use Devine OS and rely on any information or outputs entirely at your own risk.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, in no event shall DG, its affiliates, directors, employees, contractors, service providers or partners be liable to you or any third party for any indirect, incidental, special, punitive, exemplary, consequential or similar damages; for any loss of profits, revenue, goodwill, data, opportunities, business or use; for any loss or theft of digital assets (including due to hacks, exploits, bugs, key compromise, protocol failure or market events); or for any loss or damage arising from smart contract behaviour, protocol or chain failures, front-end or back-end errors, or third-party service outages.

This applies whether such liability arises in contract, tort (including negligence), strict liability or otherwise, even if advised of the possibility of such damages, and arises out of or in connection with your access to or use of (or inability to access or use) Devine OS, this website, or any vault, strategy, protocol or integration; any transaction or interaction with smart contracts, MPC wallets, bridges, exchanges or protocols referenced by or accessible via Devine OS; or any bug, exploit, hack, cyberattack, security incident, failure of encryption or MPC, or unauthorised access to systems or data.

To the extent any liability cannot be fully excluded under applicable law, the aggregate liability of DG and its affiliates to you for all claims arising out of or relating to your use of Devine OS, this website, or any related services shall not exceed the lesser of (a) the amount you have directly paid to DG for access to Devine OS (if any), and (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such cases, the exclusions and limitations above apply only to the extent permitted by law.

THIRD-PARTY PROTOCOLS, INTEGRATIONS & CONTENT

Devine OS interacts with, or may reference, third-party platforms and infrastructure, including but not limited to smart contracts, oracles, RPC providers, bridges, exchanges, custody providers, data vendors, analytics tools and communication platforms. DG does not control, endorse, audit or guarantee any third-party protocol, contract, website, API, front-end, operator or content. Your use of any third-party service is solely between you and that third party and is governed by their terms, conditions and policies. DG is not responsible or liable for any acts, omissions, losses, hacks, failures, misstatements or misconduct by any such third party.

MARKET, REGULATORY & TAX RISK

Digital assets, DeFi protocols and related markets are highly volatile and speculative. You may lose some or all of the value of any assets you allocate or interact with. Regulatory frameworks for digital assets and DeFi are evolving and may change rapidly; new laws, regulations, guidance, enforcement actions or policy decisions may adversely affect Devine OS, particular assets, protocols or your ability to use them. You are solely responsible for understanding the legal, regulatory and tax implications of using Devine OS and holding or transacting in any digital asset in your jurisdiction, and for complying with all applicable laws, regulations, sanctions regimes and internal policies. DG does not provide legal, regulatory or tax advice and makes no representation as to the treatment of any transaction or structure.

ELIGIBILITY & RESTRICTIONS

Devine OS is not intended for use by any person or entity in any jurisdiction where such use would be contrary to applicable law, regulation or policy, or where DG would be required to be authorised, licensed or registered. It is your responsibility to determine whether you are permitted to access this website or use Devine OS under the laws and regulations that apply to you. By using Devine OS, you represent that you are not prohibited or restricted from doing so and that you act in compliance with all applicable requirements.
